Four steps, one number

How to Sell Your House for Cash During a Divorce

  1. 1

    Tell us about the house

Either of you can call. Both owners have to agree to sell, so it helps to talk it over first.

  2. 2

    We walk the house

No cleaning or showings. You get a cash offer within 24 hours, and the price we offer is the price at closing.

  3. 3

    You both review it

Take the offer to your attorneys. It is the same number for both of you.

  4. 4

    Close on your date

Sign at the attorney's office or by remote online notary. The mortgage is paid off at closing, and we pay the closing costs.

Selling a House During a Divorce in Virginia

Nothing in Virginia law stops a married couple from selling their house while the divorce is going on. You usually just both have to agree.

  • If both names are on the deed, you both have to sign to sell.
  • If only one name is on the deed, the house can still be marital property. Talk to your attorney before anyone signs.
  • Virginia divides property by equitable distribution, which is not always 50/50. Most couples settle the house in a separation agreement.
  • The divorce does not change the mortgage. If you both signed the loan, you both owe it until it is paid off or refinanced.
  • A no-fault divorce needs a year apart, or six months with no minor children and a signed separation agreement.

Selling before or after the divorce, buyouts, military divorce and taxes are all in our guide, selling a house during a divorce in Virginia. We are not attorneys. Your divorce attorney should have the final word.

The honest answer

Selling to a Cash Home Buyer vs. a Buyout or Listing

If one of you wants to keep the house and can afford it alone, a buyout may be the better answer. If the house is in good shape and you can wait, listing it will usually get you more than we can pay. We will tell you that.

Selling to us makes sense when you need it done on a set date, the house needs work, or showings are the last thing either of you wants. Here is exactly how we work out an offer.

Questions About Selling a House During a Divorce

Can we sell the house before the divorce is final?

Yes. Virginia law does not stop you selling while the divorce is going on, as long as you both agree and you follow any orders the court has already made.

Does my spouse have to sign?

If both names are on the deed, yes. If only your name is on it, the house can still count as marital property, so talk to your attorney before you sign anything.

What happens to the money from the sale?

The mortgage is paid off at closing. The rest is often held until your separation agreement or the court says how to split it.

What if one of us is in the military or about to move?

You can still sell. A spouse who is deployed or has moved can often sign with a power of attorney or by remote online notary. Check the wording with the title company early.

Do we have to fix the house or keep it ready for showings?

No. We buy the house as it is, with no showings and no repairs.
